Terms of Service
These terms are an agreement between you and the operator of Roomela. Please read them — they are written to be understood, but they set out both your rights and ours.
1. Who we are
Roomela is operated by Nikolay Tolmachev, Staré Grunty 211/36, 841 04 Bratislava (“we”). You can reach us at info.roomela@gmail.com — more details are on the contact page and in the imprint.
2. What Roomela is — and what it is not
Roomela is a free online noticeboard and messaging service for rooms in shared flats and houses in Slovakia. People offering a room (“listers”) publish listings; people looking for a room browse them and message the lister. In legal terms we are a hosting (information-society) service — we provide the space and the contact, but we are not part of what happens between users.
- Roomela is not a real estate agency (realitná kancelária) and provides no brokerage services.
- Roomela is not a party to any rental contract. Any viewing, contract, deposit or payment happens directly between users, outside the platform.
- Roomela processes no payments and takes no bookings.
- Listings are published by users. We moderate them as described in section 7, but we do not verify users’ identities and cannot guarantee that every listing is accurate and trustworthy.
3. Your account
- You must be at least 18 years old and have full legal capacity (rental contracts are legally binding).
- Keep your sign-in details private; you are responsible for everything that happens under your account.
- Provide true information and keep it up to date. One person, one account.
4. Rules for listers
- Only rooms may be listed: a private room in a shared flat or house. Whole apartments, studios and other property types do not belong on Roomela yet.
- You must have the right to offer the room — as the owner, as a tenant with the landlord’s written consent to sublet (§ 719 of the Slovak Civil Code), or as someone the owner has authorized to manage the room.
- Describe the room truthfully: real photos of the actual room, an honest price and costs, real availability. Keep the listing up to date and take it down once the room is gone.
- Listings must not set discriminatory conditions (for example excluding people because of their ethnicity, religion, nationality, disability or sexual orientation).
5. Your content and the licence you grant us
You keep ownership of the content you add (photos, listing text, messages). By adding content to Roomela you:
- represent and warrant that the content is yours or that you have the necessary rights and permissions, that it is true and lawful and does not infringe anyone else’s rights (in particular copyright and data-protection rights), and that you have a legal basis for any personal data you include in it;
- grant us a free, non-exclusive licence to store, display, reproduce and use that content to operate and promote Roomela, for as long as it is posted (and briefly afterwards in technical backups);
- accept that we may remove content that appears unlawful or in breach of these terms.
6. What is not allowed
- Fake, duplicate or misleading listings.
- Scams of any kind — including asking for money before a viewing or a signed contract.
- Illegal content, harassment or abusive messages.
- Spam, advertising unrelated to rooms, or listing other property types.
- Automated scraping of the site, interfering with the security or operation of the service, or collecting or misusing other users’ data.
- Getting around moderation or limits (for example re-posting removed content from a new account).
7. How moderation works
We want every listing on Roomela to be real. In plain words:
- New listings — especially the first listings from a new account — are normally reviewed by us before they appear publicly.
- We review reports from users and may also check listings on our own initiative.
- We remove content that breaks these terms or the law, and we may restrict or suspend accounts that publish it.
- When we remove a listing or restrict an account, we tell the affected user what we decided and why. They can object by replying to that notice or by writing to info.roomela@gmail.com. Every decision is made by a human — we use no automated decision-making.
8. Reporting a listing
Anyone — with or without an account — can report a listing using the report button directly on the listing page, or by email. We confirm that we received the report and review it. Please report in good faith; knowingly false reports are themselves a violation of these terms.
9. Suspension and ending your account
- You may stop using Roomela at any time and can delete your account yourself under Profile → “Delete my account” (or ask us by email to delete it).
- We may suspend or delete accounts for serious or repeated violations of these terms, for fraud, or where the law requires it — with the explanation and objection route described in section 7.
10. Disclaimers (“as is”)
Roomela is provided free of charge and “as is”. We give no warranty that the service will always be available, error-free or secure, nor that any listing is truthful or that any user is who they claim to be. Roomela only connects users; we do not verify users’ identities or the content of listings. You deal with other users at your own risk and are responsible for your own safety, viewings, checking the other party, and any contracts, deposits and payments. We recommend following our safety tips.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for the content of user listings or messages, for the conduct of users, for anything users agree or pay between themselves, or for indirect or consequential loss (such as lost profit or lost data) arising from your use of Roomela.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our fault, for liability caused intentionally or by gross negligence, or any liability that cannot be excluded under Slovak or EU law. If you are a consumer, you keep all rights given by mandatory consumer-protection law.
12. Your responsibility to us
If a third-party claim is made against us, or we suffer loss (for example a fine or legal costs), because of your content or your breach of these terms or the law, you are responsible to us for it to the extent permitted by law. Against consumers we pursue such a claim only to the amount and on the conditions that the law allows.
13. Intellectual property
The Roomela name, logo, software, site design, and the database and arrangement of content belong to us or our licensors and are protected by law. We grant you a limited, revocable, non-transferable licence to use the service for its intended purpose. You may not copy, scrape, resell, reverse-engineer or build derivative services from the site or its content without our consent.
14. Third-party links
Roomela may contain links to third-party sites that we do not operate and whose content we are not responsible for.
15. Service changes and availability
Because Roomela is free, we may change, limit or discontinue individual features or the whole service at any time. We will give reasonable advance notice of material changes in the app. To the extent permitted by law, we are not liable for any downtime or loss of data.
16. Changes to these terms
We may update these terms (for example when we add features or the law changes). We will announce significant changes in the app with reasonable notice. Using Roomela after the changes take effect means you accept them. The date of the current version is shown at the top of this page.
17. Governing law and disputes
These terms are governed by Slovak law, and Slovak courts decide any disputes. If you are a consumer, you keep all protections that Slovak and EU consumer law give you, including the option of alternative dispute resolution before the Slovenská obchodná inšpekcia (Slovak Trade Inspection).
18. Severability and entire agreement
If any provision of these terms becomes invalid or unenforceable (for example because it would be unfair to a consumer), the remaining provisions stay in force; the invalid provision is replaced by the lawful provision closest to its original meaning. These terms, together with the pages they link to (Privacy Policy, Contact, Imprint), form the entire agreement between you and us about using Roomela.
